Tesla Enters Mediation to Potentially Settle EEOC Racism Lawsuit

Tesla has agreed to enter mediation to potentially resolve the lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC). The lawsuit accuses Elon Musk’s electric car manufacturer of allowing severe and widespread harassment of Black employees at its Fremont, California, assembly plant.

The EEOC is currently collaborating with Tesla to select a mediator, with negotiations expected to commence in March or April. Additionally, both parties are required to submit a proposal to the presiding judge by June 17 regarding the next steps if settlement discussions and mediation do not yield results.

U.S. District Judge Jacqueline Scott Corley in San Francisco approved a request on Tuesday night to pause certain evidence-gathering deadlines, allowing mediation to take precedence.




Tesla and the EEOC did not respond to requests for comment outside of business hours.

The EEOC initiated the lawsuit against Tesla in September 2023 during the Biden administration, alleging that the company’s employment practices violated federal law.

According to the agency, the harassment at the Fremont plant included racial slurs and the display of racist graffiti, such as swastikas and nooses. Disturbingly, some of this graffiti was found on vehicles coming off the assembly line.

Tesla has denied any knowledge of the harassment and claims it took appropriate actions when informed. The company has accused the EEOC of engaging in “headline-chasing.”

Based in Austin, Texas, Tesla has faced multiple lawsuits regarding the alleged mistreatment of workers at the Fremont facility. On November 17, the automaker achieved a legal victory when a California state judge ruled that over 6,000 Black workers at the plant could not pursue a class-action lawsuit against Tesla, citing that many potential witnesses were unwilling to testify.
