Kansas Man Receives Probation for Insurance and Identity Fraud Conviction

Kansas Insurance Commissioner Vicki Schmidt recently announced a significant legal outcome involving a Sedgwick County man, Marquez Gails, who has been sentenced to 24 months of probation for committing insurance and identity fraud.

Gails, aged 43, entered a guilty plea on January 9, 2026, in Sedgwick County District Court. He faced serious charges, including one felony count of fraudulent insurance act and one felony count of identity theft. The case revealed that Gails had unlawfully used another individual’s identity to purchase both a vehicle and the corresponding auto insurance.

In a further attempt to exploit the system, Gails utilized the fraudulent insurance policy to claim a payout for damages incurred to the vehicle. Upon pleading guilty, he was sentenced to 24 months of probation. However, the court stipulated that if he violates the terms of his probation, he could face 24 months of underlying prison time. Additionally, Gails was ordered to pay restitution amounting to $12,860.

Commissioner Schmidt emphasized the broader implications of such fraudulent activities, stating, “Insurance fraud costs all Kansans in the form of increased premiums every year. The Department will continue pursuing penalties against anyone committing insurance fraud in Kansas.” This statement underscores the commitment of the Kansas Department of Insurance to combat fraud and protect consumers.
