Oklahoma McDonald’s Franchisee Resolves Sexual Harassment Lawsuit

A McDonald’s franchisee in Oklahoma has reached a settlement in a federal lawsuit that accused a male supervisor of sexually harassing a teenage worker.

Arch Fellow North, LLC, which operates eight McDonald’s locations in eastern Oklahoma, will pay $80,000 and implement additional measures to resolve a sexual harassment and constructive discharge lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC) on behalf of the affected teenage worker. This announcement was made by the federal agency today.

The EEOC’s lawsuit details that the harassment occurred over a month in November 2021, during which the adult male supervisor allegedly subjected the teenage worker to inappropriate behavior. Upon learning of the allegations, Arch Fellow North did not conduct a thorough investigation and allowed the supervisor to continue overseeing the teenage victim and other young employees. Consequently, the teenage worker felt compelled to resign.

This alleged misconduct is a violation of Title VII of the Civil Rights Act of 1964, which explicitly prohibits sexual harassment in the workplace. The EEOC initiated legal action (Equal Employment Opportunity Commission v. Arch Fellow North LLC d/b/a McDonald’s, Civil Action No. 6:23-cv-00331) in the U.S. District Court for the Eastern District of Oklahoma after attempting to resolve the matter through its conciliation process prior to litigation.

As part of the consent decree, in addition to the $80,000 monetary settlement, Arch Fellow North will take several steps to ensure compliance with Title VII. This includes appointing personnel dedicated to overseeing adherence to the law, establishing robust policies and procedures for reporting and addressing sexual harassment complaints, and mandating training for both supervisors and non-supervisory staff.
