NLRB Halts SpaceX Legal Battle Over Terminated Engineers Due to Jurisdictional Concerns

The National Labor Relations Board (NLRB) is reportedly stepping back from a prolonged legal battle with Elon Musk’s SpaceX, indicating it will no longer pursue cases against the company in the future.
According to a report from Bloomberg News, a letter from the NLRB revealed that it would dismiss a case initiated two years ago, which involved the termination of eight engineers who had signed an open letter criticizing Musk.
The report highlighted that the NLRB’s decision was influenced by a recent opinion from the National Mediation Board (NMB), which determined that the engineers in question fell under its jurisdiction rather than that of the NLRB.

In the letter, Danielle Pierce, a regional NLRB director, stated, “Accordingly, the National Labor Relations Board lacks jurisdiction over the Employer and, therefore, I am dismissing your charge.”
This decision follows a court ruling last summer that deemed the NLRB’s structure likely illegal. SpaceX initiated this case, with other companies joining the challenge.

In August, the U.S. Fifth Circuit Court of Appeals in New Orleans sided with SpaceX and two other companies, ruling that the NLRB’s structure is likely unlawful and preventing the agency from pursuing cases against them.
The NMB oversees railroad and airline companies, working to avert strikes by labor groups in those sectors. In contrast, the NLRB’s jurisdiction encompasses most other private sector employers, allowing it to address unfair labor practice charges.

In contrast, employees governed by the NMB are subject to a different legal framework that does not provide the same level of protection.
